The Telephone Consumer Protection Act of 1991 requires businesses to get written or verbal opt-ins from contacts. You must also always provide a way for your contact to opt out of SMS campaigns, including notifications. One best practice is selecting an SMS provider that automatically unsubscribes customers if they reply with words such as STOP or CANCEL.

In addition, companies must register for The Campaign Registry. The registry was created to decrease the number of SPAM messages sent to consumers.
